(1) Introduction and agreement

These Terms of Service govern your use of getcrumble.net (the "Website") and any products or services we make available through it, including personalised personality reports and quizzes (collectively, "Services"). By accessing or using the Website you agree to these terms in full.

If you do not agree with any part of these terms, please do not use the Website or purchase any Services.

These terms should be read alongside our Privacy Policy, which forms part of the agreement between us.

(2) Who we are

Crumble is operated by the Crumble team, based in Melbourne, Victoria, Australia. Our website is getcrumble.net. References to "we", "us", or "Crumble" in these terms refer to the Crumble team.

(3) What Crumble is and is not

Crumble generates personalised personality reports that combine Human Design, personality typing, and learning styles. Reports are designed for personal insight, curiosity, and entertainment. Please read the following carefully before using our Services.

Crumble is not professional advice. Nothing in our reports or on our Website should be taken as medical, psychological, psychiatric, therapeutic, legal, financial, career, or any other form of professional advice. We are not registered health professionals, psychologists, therapists, counsellors, financial advisers, lawyers, or any other type of regulated professional. Use of Crumble does not establish any professional relationship between you and us.
  • Our Services are provided for personal insight, entertainment, and self-reflection only. They are not intended for use in employment, recruitment, screening, assessment, clinical, or any other professional context.
  • The personality frameworks used by Crumble -- including Human Design, personality typing, and learning styles -- are not scientifically validated diagnostic tools. We make no warranty that any report content is accurate, complete, or applicable to your specific circumstances.
  • Any decisions you make after reading your report are yours alone. We are not liable for the consequences of any such decisions.
  • Your cookie type is a starting point for curiosity. It is not a clinical diagnosis, a life instruction, or a substitute for professional guidance.
  • If you are facing a significant personal, medical, psychological, financial, or legal decision, please consult a qualified professional.

You acknowledge and agree that you are using our Services on this basis.

(4) AI-generated content

Your personalised report is generated using artificial intelligence, specifically Anthropic's Claude model. The written content of your report is created by AI based on the information you provide and is not written by a human.

  • AI-generated content is provided on an "as is" basis. We make no representations or warranties as to its accuracy, completeness, reliability, or suitability for any purpose.
  • AI outputs can sometimes be unexpected, incomplete, or not perfectly tailored to your circumstances. This is the nature of the technology and does not constitute a defect in our Services.
  • AI-generated content does not constitute professional advice of any kind. All the limitations in section (3) above apply fully to AI-generated content.
  • We do not endorse or guarantee any specific outcome, recommendation, or insight contained in your report.

By using our Services you acknowledge that your report is AI-generated and you accept the inherent limitations of that technology.

(5) Age requirement

You must be at least 16 years old to use Crumble. Our quiz enforces this requirement -- date of birth is verified at the point of submission and reports cannot be generated for anyone under 16. We do not knowingly collect or process information from anyone under the age of 16. If you believe a person under 16 has submitted information through our Website, please contact us.

(6) Payments

Some of our Services require payment. All prices are displayed in Australian dollars (AUD) and are inclusive of any applicable GST. Payments are processed by Stripe, a secure third-party payment processor. We do not receive or store your payment card details.

When you place an order, you are making an offer to purchase from us. A binding contract is formed at the point we take payment. We reserve the right to decline any order prior to payment being taken, without giving a reason.

Our Services are one-off purchases, not subscriptions. You pay once and receive access to the report described at the time of purchase.

Promotion codes and discount codes may be applied at checkout where available. Codes are subject to the specific terms attached to each code and may be withdrawn at any time without notice.

(7) Saving your report

When you purchase a paid report, Crumble generates a personalised report displayed directly in your browser. A Save as PDF button is available throughout your report so you can save it to your device at any time during your session.

Your report cannot be regenerated once you close your browser session. Because we do not store any of the personal data used to generate your report, we have no way to recreate it. We strongly recommend saving your report before closing your browser.

You are informed of this at the point you access your report and are asked to acknowledge it before your report is displayed. Saving your report is straightforward -- click Save as PDF in the report header and follow your browser's print-to-PDF instructions.

(8) Refund policy

Because our Services involve the instant generation and delivery of personalised digital content, please read the following carefully before purchasing.

Where a refund will not be given:

  • Where your report has been generated and delivered and you have accessed it, regardless of whether you saved a copy.
  • Where you are dissatisfied with AI-generated content that has been delivered as described. The nature of AI-generated personalised content means that outputs will vary and we cannot guarantee that any specific insight will resonate with you personally.
  • Where a promotion code or discount was applied and you received the report at the reduced price.
  • Where we have reason to believe information was provided dishonestly or in a way designed to obtain a refund after accessing content.

Where a refund may be considered:

  • Where payment was taken but a technical failure on our end prevented your report from being generated and delivered at all.
  • Where you were charged twice for the same report due to a payment processing error.
Your Australian Consumer Law rights are not affected. Nothing in this refund policy limits or excludes any rights you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010). If our Services are not provided with due care and skill, or are not fit for the purpose we described, you may be entitled to a remedy under Australian Consumer Law. See section (12) for more detail.

(9) Acceptable use

You may use Crumble for your own personal insight and entertainment only. You must not:

  • Use our Services for any business, employment, recruitment, screening, assessment, or other professional or commercial purpose.
  • Use our Services or report content to make or influence decisions about another person, including but not limited to hiring, performance assessment, or relationship decisions.
  • Reproduce, sell, sublicense, redistribute, or commercially exploit any part of our Website or report content without our prior written consent.
  • Scrape, data-mine, or systematically extract data from our Website by automated means.
  • Use our Website in any way that causes or may cause damage to the Website or impairs its availability or accessibility.
  • Use our Website in connection with any unlawful, fraudulent, or harmful purpose or activity.
  • Attempt to reverse-engineer, copy, or reproduce the structure or methodology of our quizzes, prompts, or report generation process.
  • Impersonate any person or misrepresent your identity or affiliation in using our Services.
  • Use our Website or content to transmit unsolicited commercial communications.

We reserve the right to suspend or terminate access to our Services where we have reason to believe these acceptable use terms have been breached.

(10) Intellectual property

Unless otherwise stated, all intellectual property rights in the Website, its content, design, code, quiz questions, report structure, brand assets, and the Crumble name and visual identity are owned by Crumble. All rights are reserved.

Your personalised report is generated for your personal use only. You may save, download, and share your own report for non-commercial personal purposes. You may not reproduce, publish, or commercially exploit report content without our consent.

You may not use the Crumble name, logo, or any of our brand assets without our prior written consent.

The personality frameworks referenced by Crumble -- including Human Design and personality type theory -- are not owned by us. We use these frameworks to inform the generation of reports and do not claim ownership of the underlying frameworks themselves.

The personality quiz used in Crumble is based on the International Personality Item Pool (IPIP), a public domain collection of personality items made freely available for research and personal use. Crumble does not claim ownership of the IPIP framework or its items.

The Crumble Clash conflict style assessment is an original assessment created by Crumble. It is not affiliated with, endorsed by, or derived from any third-party proprietary instrument.

(11) Limitation of liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable Australian law, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any rights you have under the Australian Consumer Law.

Subject to the above, and to the maximum extent permitted by applicable Australian law:

  • Our Services are provided on an "as is" and "as available" basis without any warranty, express or implied.
  • We do not warrant that our Website will be uninterrupted, error-free, or free from harmful components.
  • We are not liable for any indirect, incidental, consequential, or special loss or damage arising from your use of our Services, including loss of income, loss of opportunity, emotional distress, or any harm resulting from reliance on report content.
  • We are not liable for any loss or damage arising from technical failures, service interruptions, or third-party service failures (including failures by Stripe, Anthropic, or the Human Design API) that are beyond our reasonable control.
  • We are not liable for any use of our Services in a business, employment, or recruitment context. Our Services are not intended for those purposes and any such use is entirely at your own risk.
  • We are not liable for any decisions you make or actions you take based on report content.
  • Where our liability cannot be excluded and is not otherwise limited by law, our total aggregate liability to you in connection with these terms and your use of our Services is limited to the amount paid by you for the specific report in question.

We are not responsible for the content, availability, or practices of any third-party websites linked from our Website. Links are provided for convenience only and do not constitute endorsement.

(12) Australian Consumer Law rights

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For services, you are entitled to have them provided with due care and skill, within a reasonable time if no time is specified, and fit for any specific purpose you made known to us.

If our Services are not provided in accordance with these statutory guarantees, you may be entitled to a remedy. This may include, depending on the nature of the failure:

  • A re-supply of the service, or the cost of having the service re-supplied, where there is a minor failure.
  • A refund, or other appropriate remedy, where there is a major failure.

Nothing in these terms is intended to limit or exclude any right you have under the ACL. Our refund policy in section (8) applies alongside, not instead of, your ACL rights.

(13) Privacy

Your privacy matters to us. How we collect, use, and handle your information is described in our Privacy Policy, which forms part of these terms. By using our Services you agree to our Privacy Policy.

The short version: we do not store your personal data after your report is generated. We have no database with your name in it. Your birth data goes in, your cookie comes out, everything disappears. See the Privacy Policy for the full picture.

(14) Changes to these terms

We may update these terms from time to time to reflect changes in our Services, applicable law, or our practices. When we make changes we will update the date at the top of this page. Continued use of our Services after changes have been published constitutes your acceptance of the updated terms.

If you have concerns about any changes, you are welcome to contact us before continuing to use our Services.

(15) General

Governing law. These terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these terms or your use of our Services are subject to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia.

Severability. If any part of these terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that part will be severed and the remaining terms will continue in full force and effect.

Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of our Website and Services. They supersede all previous agreements, understandings, and representations.

No waiver. Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision. We may still enforce it at a later time.

No third-party rights. These terms are between you and us. No other person or entity has any rights to enforce any of these terms.

Force majeure. We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including natural disasters, infrastructure failures, failures of third-party services, or changes in law.

These terms are intended to comply with the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010), the Australian Privacy Act 1988, and other applicable Australian law. Crumble is a sole trader operation based in Victoria, Australia.
